Terms of Service

Participation in any activity organized (surf courses, Surfari, Personal Surf Coaching) by Atlantis Surfhostel Gran Canaria implies full acceptance of these “Terms of Service”. Should the activities be carried out by third party companies hired by Atlantis Surfhostel, those companies’ specific “Terms of Service” may apply.

1. Payment terms

In order to confirm a booking on any activity or accommodation, a 15% deposit on the following bank account is required:

The remainder, 85% of the total, is to be paid in cash upon arrival at Atlantis Surfhostel.

Conclusion of a travel contract

The booking is binding for the participant and also applies to all other participants included in the registration, for whose contractual obligations the registering participant stands surety, as he does for his own obligations. The contract comes into effect with written confirmation by Atlantis Surfhostel.

Modifications to the service

Atlantis Surfhostel expressly reserves the right to make changes to the description of the services before conclusion of the contract for reasons that are objectively justified, significant and which could not have been foreseen.

Cancellation by the client

The customer may withdraw at any time before the start of the trip. Any cancellation requires written form. The date of receipt of the note of withdrawal by Atlantis Surfhostel applies. If the customer withdraws from the travel contract or does not commence the trip, Atlantis Surfhostel may demand compensation for the travel arrangements made and for all other related expenses. For the calculation of such compensation, the normal savings in expenditure and the possible other use of the travel services must be taken into account. Atlantis Surfhostel may apply a flat-rate compensation claim in proportion to the travel price, according to the following breakdown depending on the proximity of the date of withdrawal to the contractually agreed start of travel:

  • until 25 days before start of travel 30 €,
  • until 14 days before start of travel 30% of the travel price,
  • afterwards 80%,
  • from the 3rd day before start of travel on 100%.

There is no claim for change of booking. Up to the date of the start of travel the client may find a replacement to take over his or her rights and responsibilities. Atlantis Surfhostel may reject the entry of a third party due to important reasons. If a third party enters into the contract, the third party and the traveler will be liable to Atlantis Surfhostel as jointly and severally liable for the travel price and the extra costs incurred by the third party. It is the customer’s responsibility to prove that no or substantially lower costs have been incurred in connection with the withdrawal from the trip than the flat-rate costs indicated by Atlantis Surfhostel.

Withdrawal and cancellation by Atlantis Surfhostel

Atlantis Surfhostel may withdraw from the travel contract prior to commencement of the trip or cancel the travel contract after commencement of the trip: Without previous notice, if the client persistently interferes with the conduct of the trip, despite a warning issued by Atlantis Surfhostel or its representative (e.g. does not follow the instructions of the course instructors) or if he or she behaves in violation of the contract to the extent that the immediate termination of the contract is justified. In the case of cancellation by Atlanis Surfhostel, the claim for the travel price is retained. However, the savings in expenditure as well as the advantages obtained from the unused services must be taken into account by Atlantis Surfhostel, including the amounts credited by other service providers.

6. Cancellation of the contract due to exceptional circumstances

If the journey is severely impaired, endangered or affected by unforeseeable force majeure at the conclusion of the contract, both Atlantis Surfhostel and the traveler can terminate the contract. If the contract is terminated, Atlantis Surfhostel will be entitled to demand reasonable compensation for the services already provided or to be provided to terminate the journey.

7. Duty of cooperation

The traveler is obligated to take reasonable action in case of possible performance problems, in order to contribute to a remedy of the problem and to keep any resulting damage to a minimum. In particular, the traveler is obligated to report his or her complaints immediately on site.

8. Exclusion of claims and limitation

Claims due to services not rendered according to the contract of travel are to be made by the traveler within a month after the contractual end date of the trip. Claims of the traveler shall become statute barred within one year. If the traveler has asserted such claims, the limitation period shall be suspended until the day Atlantis Surfhostel rejects the claims.

9. Passport, visa and health regulations, insurance

The traveler is responsible for complying with all regulations which are necessary for the execution of the trip. The traveler is responsible for complying with all regulations which are important for the execution of the trip. For travelers without German citizenship, there is the obligation to obtain information on passport, visa and health regulations from the competent consulate. If the visa is not complied with by the traveler, or if a visa is not given in time by the fault of the traveler so that the traveler is prevented from traveling, Atlantis Surfhostel can charge the traveler with appropriate cancellation fees.

Subsidiary agreements, invalidity of individual provisions

Subsidiary agreements and other pledges shall only be effective if they are confirmed in written by Atlantis Surfhostel. The invalidity of individual provisions of the travel contract does not result in the invalidity of the entire travel contract.
